Booking Terms & Conditions

Sailing Noonmark VI LTD (hereafter referred to as “the Company”) operates Noonmark VI for skippered yacht charters. By making a booking, the Client agrees to the following terms and conditions. 

 

 

1. Booking and Payment

a. A booking is confirmed once the Company receives a completed booking form and deposit. 

b. The deposit amount is 25% of the total charter fee. 

c. The balance must be paid in full no later than 90 days before departure. 

d.  If the full payment is not received on time, the Company reserves the right to cancel the booking, and the deposit will be forfeited. 

2. Client Responsibilities

a. The Client must provide accurate information during booking, including any relevant medical conditions. 

b. The Client must comply with the instructions of the skipper and crew at all times for safety reasons. 

c.  The Client is responsible for securing personal belongings. The Company is not liable for lost or damaged items. 

d.  The Client must not engage in any illegal activity or behaviour that endangers the safety of the vessel, crew, or other passengers.

e.  Smoking and Vaping is only permitted on deck where it does not  interupt the enjoyment of other passengers.

3. Eligibility and Fitness to Sail

a. The minimum age for participation is 18 years old, unless accompanied by a responsible adult. Bookings for under 18 year olds needs to be 

    made by contacting the company.  Minimum age for accompanied children is 16 years old. Children of all ages are welcomed where the client is chartering the      whole boat.

b. Clients must ensure they are physically capable of participating in a sailing trip and disclose any medical conditions that may affect their ability to do so. 

c.  The Company reserves the right to refuse boarding to anyone deemed unfit to sail. 

4. Cancellation by the Client

a.   If the Client cancels their booking, the following refund policy applies: 

      More than 90 days before departure – 50% of deposit. 

      Between 61 and 90 days before departure – 50% of the total charter cost if paid in full. 

      60 days or less before departure – No refund. 

b.  All cancellations must be made in writing to info@noonmarkvi.com 

c.  If the Client is unable to attend, they may transfer their booking to another person with prior approval from the Company. 

5. Cancellation by the Company

 a. The Company reserves the right to cancel a booking due to: 

      Adverse weather conditions. 

      Unforeseen technical issues with the vessel. 

      Insufficient participant numbers.  

     Any other safety-related concerns. 

 b.   In the event of a cancellation by the Company, Clients will be offered: 

     A full and prompt refund, or 

     An alternative charter date (subject to availability). 

c. The Company is not liable for additional expenses incurred by the Client, such as travel costs. 

6. Changes to Itinerary 

 a.   The Skipper has full authority to adjust the itinerary based on weather conditions, tides, or safety considerations. 

 b.   No refunds or compensation will be provided for itinerary changes made by the Skipper. 

7. Safety and Conduct

a. The Skipper’s decisions are final in all matters of safety and navigation. 

b.  Clients must follow safety instructions at all times, including wearing life jackets when required. 

c.   If a Client’s behavior is deemed unsafe, disruptive, or in violation of these terms, the Company reserves the right to remove them from the charter without a           refund.

d.  The routing of the Voyage will take account of the weather, tides, the aptitude of the crew and at all times the safety of the whole crew, and the Skipper’s                  decision will be final.

e.  To comply with the International Ship and Port Facility Code the Client must not bring on board any goods or articles of an inflammable or dangerous nature,        nor any controlled or prohibited substance.

f.  Clients may be requested to produce ID/passport for presentation at Border Control where appropriate.

g.   Noonmark IV is certified by the relevant authorities and her Skipper is fully qualified.

h.   Lifejackets and safety lines will be provided.

8. Insurance Requirements

 a   All Clients must have travel insurance covering: 

      Sailing activities up to 60 nautical miles offshore. 

      Medical emergencies and evacuation. 

      Personal accident and trip cancellation. 

b  The company will require sight of the clients travel insurance 2 weeks prior to departure. Failure to provide this will result in the client  not being able  to join           the trip. The company will not be liable to any expenses the client may have experienced.   

9. Travel Documents

a.  The Client is responsible for ensuring they have the correct travel documents, including passport.

b.  If the Client is denied boarding due to incorrect documentation, no refund will be issued. 

10. Meals and Dietary Requirements

a.  Meals and refreshments are provided during the charter. 

b.  Dietary requests must be communicated at least two weeks before departure. While the Company will make every effort to accommodate requests, it                      cannot  guarantee a completely allergen-free environment.

c.  2 free beers or glasses of wine will be provided free of charge with evening meal. All other alcoholic drinks will be charged. 

d. Clients may bring their own alcohol. For safety and the consideration of all guests, alcohol consumption is at the discretion of the Skipper.

11. Health and Fitness

 a.  Clients must disclose on the Medical Questionnaire as a minimum:

         If they are suffering from a medical condition or allergy.

         If they have any ongoing medical condition.

         If they have limited mobility.

         If they have recently been discharged from hospital.

        If they are pregnant.

        If they are on prescribed medication.

b.  Clients are responsible for carrying the correct medication for the voyage.

c.  The Skipper cannot administer any medication except in first aid situations.

12. Liability and Indemnity

a.   The Company is insured and operates in compliance with maritime safety regulations. However, Clients participate in sailing activities at their own risk. 

b.   The Company is not responsible for: 

       Loss or damage to personal belongings. 

       Injuries or accidents that occur due to the Client’s negligence or failure to follow safety instructions. 

       Delays or disruptions caused by force majeure (e.g., severe weather, government restrictions). 

c.   Clients agree to indemnify the Company against any claims resulting from their actions or non-compliance with these terms. 

13. Photography and Media

a.    The Company may take photos or videos during charters for promotional purposes. 

b.    If the Client does not wish to be included in promotional materials, they must notify the Company in writing before the trip. 

14. Complaints and Dispute Resolution

a.    Complaints should be raised with the Skipper during the trip for immediate resolution. 

b.    If the issue is not resolved, a formal complaint must be submitted in writing within 28 days of the trip’s conclusion. 

c.    Any legal disputes will be governed by the laws of Scotland and resolved within its jurisdiction. 

15. Data Protection

a.   The Company collects and processes personal data in accordance with its Privacy Policy. 

b.   By booking, the Client agrees to the use of their data for operational and administrative purposes. 

16. Amendments to Terms

     The Company reserves the right to update these Terms and Conditions at any time.  Clients will be notified of significant changes before their charter date. 

17. St Kilda

    As St Kilda is an exposed off-shore passage, there may be times when the journey is no an option from a safety perspective. The Skippers decision in final and      no form of refund will be made if this part of the trip is not possible.

18. Pets & Animals

       No animals will be permitted onboard under any circumstances

 

19. Clients financial loss

       The company will not be responsible for any financial loss incurred by the client to include, but not limited to - Travel, Out of pocket expenses, loss of income         or savings 

20. Company Insurance

        Noonmark VI Ltd carries public liabilty insurance of £5,000,000.

 

Acceptance of Terms

a.  By confirming a booking with Sailing Noonmark VI LTD, the Client acknowledges that they have read, understood, and agreed to these Terms and                             Conditions. 

 b. The Company will issue a Booking Confirmation. It is the Client’s responsibility to check the details on the Booking Confirmation and inform The Company of        any discrepancies immediately upon receipt.
